General terms and conditions of sale

The present sales conditions aim to define the contractual relations between Domaine Peter Sichel, 10 route de Duilhac, CD 14 - 11350 Cucugnan, registered in the Trade and Companies Register of Narbonne under the number 379 989 213 and the buyer and the conditions applicable to any purchase made through the Domaine Peter Sichel's commercial site, whether the buyer is a professional or a consumer.


The acquisition of a good or a service through this site implies an acceptance without reserve by the buyer of the present conditions of sale.
The Peter Sichel Estate reserves the right to modify its sales conditions at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer.

Characteristics of the goods and services offered
The products and services offered are those which appear in the catalogue published on the Domaine Peter Sichel website, in particular the sale of wines produced and bottled at the Domaine Peter Sichel.
The wines, packaged in boxes of 6 bottles of 75cl, will be offered while stocks last.
Each wine is accompanied by a description drawn up by Domaine Peter Sichel. The photographs in the catalogue are as accurate as possible but cannot ensure a perfect similarity with the product offered, particularly with regard to colours.

Rates
The prices appearing in the catalogue are prices including all taxes in euros taking into account the VAT applicable on the day of the order; any change of the rate could be reflected on the price of the products or services.
The Peter Sichel Estate reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalogue on the day of the order will be the only one applicable to the buyer.
The prices indicated include the costs of processing orders.
The delivery price is indicated in euros, including all taxes for a delivery to the same address in metropolitan France in the geographical areas provided below.

Geographic area
The online sale of the wines presented on the site is reserved for buyers who reside in metropolitan France. For all deliveries outside France, please contact Domaine Peter Sichel.

Controls
The buyer, who wishes to buy bottles of wine, must fill in the identification form on which he will indicate all the details requested:
- Fill in the online order form giving all the references of the products or services chosen,
- validate his order after having checked it,
- make the payment in accordance with the conditions provided,
- confirm his order and payment.
Confirmation of the order implies acceptance of these terms and conditions of sale, recognition of having full knowledge of them and waiver of its own conditions of purchase or other conditions.
All the data provided and the recorded confirmation will be worth proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out.
The seller will communicate by e-mail confirmation of the registered order.

Withdrawal and return policy
Buyers, non-professional individuals, have a withdrawal period of seven days from the delivery of their order to return the product to the seller, for exchange or refund without penalty, except for return costs.

The terms of return are as follows:
1. Damaged parcel - Do not accept the delivery. If you were not present, please contact us at 04 68 45 01 13 or by mail : contact@domainepetersichel.com . within 5 working days. After investigation with our carrier, the latter will take charge of the return of all the bottles. We will send you a new parcel in exchange without any additional cost to you.
2. Packages with non-ordered bottles: You send us the package in its packaging at your expense. We will replace the unordered bottles and reimburse you for your shipping costs by check or Paypal transfer.
3. Corked bottle: Domaine Peter Sichel will also exchange any defective product provided that the bottle is at least three quarters full and that it was purchased less than a year ago, the date of the order being taken as proof. In the case of a defective product, please contact us at 04 68 45 01 13 or by email at contact@domainepetersichel.com. Upon acceptance, we will send you a replacement bottle by mail.

Terms of payment
The price is payable at the time of ordering.
Payments will be made by credit card; they will be made through a secure system that uses SSL (Secure Socket Layer) so that the information transmitted is encrypted by software and no third party can read it during transport on the network.
The buyer's account will only be debited when the available products or services are shipped, and only for the amount of the products or services sent or downloaded.
The buyer can also pay by check or bank transfer. His order will be honoured upon receipt of the cheque or proof of transfer provided by the bank of the Peter Sichel Estate. It is understood that the shipment of the order will be slightly delayed.
At the buyer's request, a paper invoice will be sent to him showing the VAT.

Deliveries
Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area.
The risks are borne by the purchaser from the moment the products have left the Domaine Peter Sichel premises. In case of damage during transport, a justified protest must be made to us and to the carrier within three days of delivery.
Delivery times are given as an indication only; if they exceed thirty days from the order, the sales contract may be cancelled and the buyer reimbursed.

Warranty
All products supplied by the seller benefit from the legal guarantee provided by articles 1641 and following of the Civil Code.
In case of non-conformity of a product sold, it can be returned to the seller who will take it back, exchange it or refund it.
All claims, requests for exchange or refund must be made by post to the following address Domaine Peter Sichel, 10 route de Duilhac CD 14, 11350 Cucugnan within eight days of delivery (as evidenced by the postmark).

Responsibility
The seller, in the process of selling online, is only bound by an obligation of means; its responsibility cannot be engaged for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break in service, or other involuntary problems.

Intellectual Property
All elements of the Peter Sichel Estate website are and remain the exclusive intellectual property of the Peter Sichel Estate.
No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio.

Personal data
In accordance with the law relating to data processing, files and freedoms of January 6, 1978, the information in personal matter relating to the purchasers could be the subject of an automated treatment.
The Domaine Peter Sichel reserves the right to collect information about the buyers, including by using cookies, and, if it wishes, to transmit the collected information to commercial partners.
The buyers can object to the disclosure of their details by notifying Domaine Peter Sichel. Similarly, users have the right to access and rectify data concerning them, in accordance with the law of 6 January 1978.
The automated processing of information, including the management of e-mail addresses of users of the site has been declared to the CNIL.

Archiving - Proof
The Domaine Peter Sichel will archive the order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
The computerized registers of the Peter Sichel Estate will be considered by the parties as proof of the communications, orders, payments and transactions between the parties.

Dispute Resolution
The present conditions of sale on line are subjected to the French law.
In the event of a dispute, jurisdiction is given to the competent courts of Narbonne, notwithstanding the plurality of defendants or the call for guarantees.
